Fresenius threatened by class action lawsuit in U.S.

Frankfurt. The world's largest dialysis company Fresenius Medical Care (FMC) threatened because of inadequate information on side effects of dialysis solutions, a class action in the United States. A group of patient advocates had filed an application process against the Company, the subsidiary of the Fresenius health care group said yesterday in Bad Homburg. Accordingly, pending in the U.S. product liability claims to be against the U.S. subsidiary of Fresenius Medical Care North America at the U.S. Department of Justice in Boston, Massachusetts, merged. These complaints relate to inadequate information about possible side effects on the labels of the two dialysis solutions NaturaLyte and GranuFlo.
FMC Chairman Ben Lipps assumes that these claims are unfounded. The company will however work with the U.S. Department of Justice.

In the dispute over copyright infringement on the online video platform YouTube, the operator has made Google a success. A court in New York rejected a request to summarize a number of cases in a huge class action. As justification led to the presiding judge Louis Stanton that copyright issues are often stored very differently and therefore had to be decided from case to case. Therefore a class action have little meaning.
In the case of Google's YouTube also logistical considerations would suggest otherwise. "The idea that a class action could be regulated by this dimension with judicial ingenuity, though flattering, but unrealistic," Stanton wrote in the court's opinion. Had the Court accepted the class action, the case would become a mammoth process.
